These are the terms and conditions (“Rules”) that apply to the Jellycat Bartholomew Bear’s Birthday Box Competition (“Promotion”). By entering the Promotion, each entrant agrees to these Rules and confirms they have read and understood our Privacy Notice at www.jellycat.com/privacy-cookies/.
Your Instagram account must be set to “public” during the Promotion entry period.

1. Promoter: Jellycat Limited, a company registered in England (company no. 03591414) with its registered office address at Westworks Building, 195 Wood Lane, London, England, W12 7FQ (“Jellycat”).
2. Entry period: The Promotion opens for entry at midday 12PM (UK time) on Monday 26th May and closes at 5PM (UK time) on 9th June 2026 (“Entry Period”).
3. Eligibility: Entry is open to legal residents of Australia, Canada, France, Germany, the United Kingdom (England, Scotland, Wales and Northern Ireland) and the United States who are at least 18 years old at the time of entry and accept that the Promotion is governed by laws of England and Wales. The Promotion is not open to employees and contractors of Jellycat or any promotion administrator or prize provider, their families and households and anyone else professionally involved or associated with the Promotion. Jellycat reserves the right at any time to require proof of eligibility in such form as Jellycat reasonably considers necessary.
4. How to enter: To enter the Promotion
Post a photo or video to your Instagram grid showing your Jellycats celebrating Bartholomew’s birthday, including the following:
- Make sure that your post is set to public, rather than private, otherwise we won’t be able to see it.
- Add the hashtag #BartholomewsBearsBirthday
- Make sure you are following Jellycat & Jellyfriends

5. No cost to enter: The Promotion is free to enter.
6. Limit on number of entries: A limit of one (1) entry per person applies to this Promotion. You are welcome to post more than 1 photo or video from a single account, but this will count as only 1 entry into the Promotion. Jellycat reserves the right at any time to disqualify anyone found to have entered the Promotion more than once, for example by using multiple accounts.
7. Entry guidelines: Entries must not be, or contain any material which is, or may reasonably be considered to be, threatening, defamatory, inflammatory, obscene, indecent, offensive, profane, abusive, pornographic, sexually explicit or suggestive, violent, derogatory of any ethnic, racial, gender, religious, professional or age group, discriminatory in any way or otherwise unlawful. Entries must not contain any content that infringes or misappropriates the intellectual property, privacy or publicity rights of any third parties. Entries must not defame, misrepresent or contain disparaging remarks about Jellycat or its products or services, or other people, companies or products and services.
8. Prizes: There are 5 prizes and each winner will win the following:

(collectively, a ‘Prize’). The approximate retail value of each Prize is £170 / € 197.
9. Prize conditions: Prizes are non-transferable, non-refundable, non-exchangeable and no cash alternative is available. However, if it becomes necessary for reasons beyond Jellycat’s control (e.g. if a Prize becomes unavailable for any reason), a Prize may be varied or swapped for a suitable alternative in Jellycat’s discretion which is of equivalent or higher retail value.
10. Winner selection: All eligible entries from across all eligible countries will be selected by randomised lottery on 18th of June. The winners will be the 5 entrants whose names are drawn at random from all eligible entries. A single entrant cannot win more than one prize. Odds of winning depend on the number of entries received.
11. Winner notification: The winner will be notified by direct message on Instagram from the official @Jellyfriends or @Jellycat Instagram account within 1 week of the completion of the winner selection process. Jellycat will make reasonable efforts to contact winners, but it is each winner’s responsibility to monitor their Instagram account for receipt of the notification.
12. Claiming the Prize: Winners must claim their Prizes within 14 (fourteen) days of Jellycat’s initial win notification by providing the information requested in the win notification (name, contact email address, postal address).
13. Prize delivery: Prizes will be delivered to winners at the addresses notified to Jellycat during the claim process. Jellycat aims to deliver the prize within 3 weeks of a valid claim. Subject to clause 14, Jellycat is responsible for all costs arising from the delivery of the Prize to the winner.
14. Taxes relating to Prizes: Winners are solely responsible for the reporting and payment of all applicable national, state or local taxes or social contributions on the Prizes or arising from the acceptance of the Prizes.
15. Forfeiture of Prize: If any winner fails to claim the Prize or fails to provide any information required by Jellycat by the claim deadline, Jellycat reserves the right to disqualify the winner and select an alternative winner. The alternative winner will be selected using the same process as the original selection process and must claim their Prize within 2 days of Jellycat’s win notification.
16. Liability: Nothing in these Rules limits or excludes any person’s liability for death or personal injury caused by negligence, for fraud or for any matter for which liability cannot be lawfully limited or excluded. In particular, consumers have legal rights in relation to products that are faulty or not as described and services which are not performed with reasonable care and skill and these legal rights are in addition to and are not affected in any way by anything contained in these Rules. However, to the fullest extent permissible by law, Jellycat will not be liable for: (i) Unexpected (“unforeseeable”) loss. Jellycat is not responsible for any loss you suffer (as a result of Jellycat’s negligence or breach of these Rules or otherwise) if it was not obvious that you would suffer such loss and nothing you said to Jellycat before you entered into this Promotion meant that Jellycat should have expected it to happen (so, in the law, the loss was “unforeseeable”); (ii) Avoidable loss. Jellycat is not responsible for any loss you suffer (as a result of Jellycat’s negligence or breach of these Rules or otherwise) if you could have avoided such loss by taking reasonable action; (iii) Loss caused by someone else. Jellycat is not responsible for any loss you suffer that is caused by a third party who is not acting on behalf of or under the direct instructions of Jellycat; (iv)Loss caused by circumstances outside Jellycat’s control. Jellycat is not responsible for any loss you suffer that is caused by any event or circumstance that is beyond Jellycat’s reasonable control; (v)Business loss. Jellycat is not responsible for any business losses you suffer, such as loss of profits or revenue, loss of anticipated savings or loss of goodwill; and (vi) Unavailability of Jellycat’s services. Jellycat is not responsible for any loss you suffer as a result of the unavailability of Jellycat’s websites, apps or social media accounts.
For residents of France only: in accordance with Article L221-15 of the French Consumer Code, Jellycat may be relieved of all or part of his liability if it demonstrates that any breach or improper performance of the Rules is attributable either to the winner, to the unforeseeable and insurmountable act of a third party unrelated to these Rules, or to a case of force majeure.
For residents of Germany only: Jellycat, its legal representatives and its agents shall be fully liable for intent and gross negligence as well as for damages caused by injury to life, body or health. (i) In the event of slight negligence, Jellycat shall be liable only for breaches of a material contractual obligation (cardinal duty). A “cardinal duty” in the meaning of this provision is an obligation whose fulfilment makes the implementation of this contract possible in the first place and on the fulfilment of which the contractual partner may therefore generally rely; (ii) In a case according to section (i), Jellycat shall not be liable for any lack of commercial success, lost profits and indirect damages; (iii) Liability in accordance with the above sections (i) and (ii) shall be limited to the typical, foreseeable damages; (iv) The limitation of liability shall apply mutatis mutandis to the benefit of the employees, agents and vicarious agents of Jellycat; (v) Any potential liability on the part of Jellycat for any warranties and for claims based on the German Product Liability Act shall not be affected.
17. No endorsement: The Promotion is in no way sponsored, endorsed, administered by or associated with Instagram or any other third party. All third-party trademarks and other intellectual property rights are hereby acknowledged. Use of and entry to promotions via Instagram is always subject to the rules, terms and policies of Instagram. By participating in the Promotion, entrants are providing information to Jellycat, not to Instagram. To the maximum extent permitted by applicable law, Instagram shall have no liability to any person in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, damages and other liabilities.
18. Cancellation and variation: Jellycat reserves the right to vary, suspend or cancel the Promotion and/or these Rules if it considers it necessary or appropriate to do so, including if there is any actual or anticipated breach of applicable law or if variation, suspension or cancellation is necessary due to an event outside Jellycat’s reasonable control. In the event of cancellation, Prizes may be awarded to winners drawn from entries received prior to cancellation.
For residents of Germany only: In the event of cancellation due to unavailability of performance, Jellycat will inform the entrants without undue delay of the unavailability and, where applicable, will reimburse the entrants for consideration without undue delay.
19. Disqualification: Without limiting the options available to Jellycat, Jellycat reserves the right at any time to disqualify entries or entrants that Jellycat regards as being in breach of these Rules, any applicable laws, any terms and conditions referred to in these Rules and/or the spirit of the Promotion.
20. Interference with the Promotion: Any attempt to damage or undermine the content or legitimate operation of the Promotion is prohibited and may also be a violation of criminal and/or civil laws. Jellycat reserves all its rights and remedies to deal with such action including, without limit, to exclude any entrant or winner believed to be associated with such action.
21. Publicity: By entering the Promotion, each entrant agrees that, in the event of a win, Jellycat shall be entitled (but not obliged) to announce their names (and/or social media handles if applicable) on Jellycat’s websites and social media. Entrants may also be asked (without further reward) to take part in reasonable publicity connected with the Promotion. Entrants retain their right to refuse participation in publicity activities and their refusal to participate will not prevent any entrant from being awarded the Prize.
22. Grant of rights in UGC: By entering the Promotion, each entrant grants Jellycat a royalty-free, global and irrevocable license to use the photos or videos submitted as entry into the Promotion for the duration of the copyright, for marketing and advertising purposes worldwide in digital, print and on any other existing or future media, with the exception of image rights.
23. Disclosure of winner’s details: By entering the Promotion, each entrant acknowledges that in the event of a win their surname and county of residence (or in the case of non-UK winners, their country of residence) may be disclosed to persons enquiring, where permitted by law. Any entrant may object to their information being made available in this way, or may request that the amount of information made available be reduced, by contacting Jellycat using the contact details at the end of these Rules. In these circumstances, the entrant acknowledges that Jellycat may nevertheless disclose the relevant information, and the entrant’s entry, to the United Kingdom’s Advertising Standards Authority (and/or any other competent authority in any eligible country) if required to do so. By way of example, this may happen if Jellycat is required to demonstrate that it has awarded any advertised prizes. To request disclosure of winner details, enquirers must submit a request to [email protected] within one (1) month following the end of the Entry Period. Details will only be disclosed (if permitted by law) after all Prizes have been awarded.
24. Personal data: Entrants acknowledge that any personal data processed in connection with the Promotion will be processed in accordance with Jellycat’s Privacy Notice, which is included in the privacy notice at the end of these rules, and at www.jellycat.com/privacy-cookies/.
25. Accessing these Rules: Any website on which these Rules are posted is only intended to be accessed from Australia, Canada, France, Germany, the United Kingdom and the United States where permitted by law. Jellycat makes no representation that materials relating to the Promotion are appropriate or available for use at other locations. Access to them from territories where their contents are illegal is strictly prohibited.
26. Severance and waiver: If any part of these Rules is or becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the rest of these Rules will not be affected. Jellycat’s failure to enforce any term of these Rules will not constitute a waiver of that provision.
27. Disputes: Subject to the “Law and Jurisdiction” section below, if there is a dispute about the Promotion or these Rules, Jellycat’s decisions are final. If there is a conflict between these Rules and any other document referred to in these Rules, these Rules take precedence to the extent necessary to resolve the conflict.
28. Law and jurisdiction: All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and Jellycat in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of England and Wales, except that for German entrants, German laws shall apply. This section does not limit or exclude any rights entrants may have under the mandatory law of their own country. Any disputes arising in connection with the Promotion and/or these Rules shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that residents of other eligible countries and those parts of the United Kingdom outside England and Wales may also bring proceedings in their local courts.
